Terms of service

These terms of service ("Terms") apply to your use of klooker.com and the Klooker membership (together, the "Service"). By creating an account, starting a free trial or becoming a member, you agree to these Terms. Please also read our Privacy policy, which explains how we handle personal data.
1. Who we are

In these Terms, "Klooker", "we" and "us" mean Klooker BV. "You" means the person using the Service.
2. The service
Klooker is a curated directory of independent sustainable shops in Europe. Browsing the directory is free. A paid membership (or an active free trial) unlocks the discount codes that those shops offer to Klooker members.
To use the Service you must be at least 18 years old. The Service is for personal, non-commercial use.
3. Your account
You log in with your email address. We do not use passwords: each time you log in, we send a one-time login link to your inbox. Keep access to your email account secure, because anyone who can open your login links can use your account.
One account is for one person. Please give us a working email address so we can reach you about your membership.
4. Membership and prices
Klooker offers three recurring membership plans:

Prices are in euros and include VAT. The price and plan that apply to you are the ones shown at checkout.
Free trial. Every plan starts with a 7-day free trial. You enter your payment details when you start the trial. If you do not cancel before the trial ends, your first payment is taken at the end of the trial and your membership continues on the plan you chose.
Automatic renewal. Your membership renews automatically for the same plan length at the end of each period, and we charge the price of your plan unless you cancel before the renewal date.
Payments. Payments for new memberships are processed by Stripe. Members who joined Klooker before the current membership system (legacy members) keep paying through PayPro under their existing arrangement until they cancel or switch plans.
Price changes. We may change membership prices for future periods. We will tell you by email in good time before a new price applies to you. If you do not agree, you can cancel before the new price takes effect.
Failed payments. If a payment fails, we may try again and may pause member features until the payment goes through. If payment keeps failing, we may end the membership.
5. Cancelling
You can cancel at any time:
- through the customer portal, which you can open from your account on klooker.com (Stripe members); or
- by emailing support@klooker.com from the email address on your account (all members, including legacy PayPro members).
If you cancel during the free trial, you will not be charged. If you cancel after a payment, cancellation takes effect at the end of the period you have already paid for. You keep member access until then, and you will not be charged again.
6. Right of withdrawal
If you are a consumer in the EU, you have the right to withdraw from your membership within 14 days of signing up, without giving a reason. To withdraw, email support@klooker.com with a clear statement that you want to withdraw.
Because your membership starts straight away, at your request, we may deduct a proportional amount for the paid days you used before withdrawing. We refund the rest within 14 days using the same payment method. If you withdraw during the free trial, nothing is charged.
After the 14-day period you can still cancel at any time as described in section 5, but amounts already paid for the current period are not refunded, unless the law requires otherwise.
7. Discount codes
Discount codes are personal and for the member's own use. Do not publish, share, sell or otherwise pass on member codes.
Codes are offered by the shops and are subject to each shop's own conditions (such as minimum order values, excluded products, end dates or country limits). Shops can change or withdraw an offer at any time. We update the listing as soon as we know, but we cannot guarantee that every code will always work or give a particular saving.
If a code does not work, let us know at support@klooker.com and we will check it with the shop.
8. Purchases at shops
When you buy something from a shop listed on Klooker, your order is a contract between you and that shop. Klooker is not the seller and is not responsible for the products, prices, delivery, returns or warranties. The shop's own terms and privacy policy apply. Questions about an order should go to the shop.
9. Acceptable use
You agree not to:
- copy, scrape or collect content or codes from the Service in bulk or by automated means;
- try to get around the membership or other access controls;
- disrupt the Service or attempt to access systems or data you are not authorised to access;
- use the Service for anything unlawful or misleading.
We may suspend or end your account if you seriously or repeatedly break these Terms. If we end a paid membership for a reason other than a breach by you, we will refund the unused part of the period you paid for.
10. Intellectual property
The Klooker name, logo, website, texts and selection of shops belong to Klooker BV or its licensors. You may use them only to use the Service for yourself. Shop names and logos belong to the shops concerned.
11. Availability and changes to the Service
We work to keep the Service available and accurate, but we cannot guarantee that it will always be available or free of errors. We may change or improve the Service, and add or remove shops and offers. If we stop offering the membership, we will refund the unused part of any period you paid for.
12. Liability
We are responsible for the Service as required by law. We are not liable for:
- products, services or offers of the shops listed on Klooker;
- a discount code that a shop has changed, withdrawn or refuses;
- indirect or consequential loss, such as lost profits or missed savings.
To the extent the law allows, our total liability to you is limited to the membership fees you paid us in the 12 months before the event that caused the damage.
Nothing in these Terms limits liability for intent or gross negligence, or any rights you have as a consumer under mandatory Dutch or EU law.
13. Changes to these Terms
We may update these Terms, for example when the Service or the law changes. We will post the new version on this page with a new "Last updated" date. If a change is significant, we will tell you by email before it takes effect. If you do not agree, you can cancel your membership before the change takes effect.
14. Applicable law and disputes
These Terms are governed by Dutch law. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer law of your country.
If you have a complaint, please email support@klooker.com first. We aim to reply within 14 days. If we cannot resolve it together, the dispute may be brought before the competent court in the Netherlands, or before the court where you live if you are a consumer.
